USPTO Releases Long-Awaited Guidelines on Patentable Subject Matter
USPTO (United States Patent and Trademark Office) Announces New Guidelines.
On December 15, 2014, the USPTO issued the long-awaited interim guidelines on subject matter eligibility. These new guidelines supersede those issued in March 2014; they provide new guidance for analyzing if the claimed subject matter is patent eligible.
At first glance, these rules seem to be more flexible than the previous guidelines. In fact, many of the examples listed show more patent eligible subject matter than ever before.
This is sparking a lot of chatter in the industry, because it is safe to assume that the new guidelines will propel the examination of those patent applications which were stalled due to the previous guidelines.
